How to Choose the Right Car Accident Lawyer in Tyler, TX

After a car accident in Tyler or Smith County, you will hear from lawyers fast. Billboards. TV ads. Mailers that somehow arrive before your car is even out of the shop. Every one of them claims to be the best, the toughest, the most experienced.

So how do you actually choose the right car accident lawyer near you — one who is going to fight for your maximum recovery instead of just processing your case like a number?

This guide cuts through the noise. After more than 30 years of handling personal injury cases in Tyler, Texas, J. Chad Parker has seen exactly what separates attorneys who get results from attorneys who get settlements that leave money on the table. Here is what you need to know before you sign anything.

Why the Car Accident Lawyer You Choose Matters More Than You Think

          1. Are You Board Certified in Personal Injury Trial Law?

Board certification by the Texas Board of Legal Specialization is the clearest objective credential a personal injury lawyer can hold. It requires proof of experience, peer recommendations, and passing a rigorous exam. Ask any attorney you’re considering whether they are board certified — and in what specialty.

          2. How Much of Your Practice Is Personal Injury?

Some attorneys handle personal injury cases alongside divorce, DWI defense, real estate transactions, and estate planning. Personal injury law — and specifically car accident litigation — is a specialized field. You want an attorney whose entire practice is built around it, who knows the insurance industry, knows how to value injuries, and knows the Smith County courts.

Personal injury is all J. Chad Parker does.

          3. Will You Actually Take My Case to Trial?

This is the most important question most accident victims never ask. Many personal injury attorneys settle virtually every case because going to trial is expensive, time-consuming, and uncertain. A lawyer who never goes to trial loses all leverage with insurance companies — because the insurers know it.

Ask directly: What percentage of your cases go to trial? What were the results? Can you show me past verdicts?

Chad Parker’s results speak for themselves — including a $1,250,000 verdict in a car wreck with serious injuries and multiple seven-figure results across his career.

          4. Who Will Actually Handle My Case?

At large personal injury firms, your initial consultation may be with a senior attorney — but your case is then handed to a junior associate or paralegal. You may rarely speak to the attorney whose name is on the door.

At J. Chad Parker PLLC, Chad Parker personally reviews your demand before it goes to the insurance company. You work directly with the attorney you hired.

          5. How Do You Communicate With Clients?

Being injured and waiting on updates about your case is stressful. Ask any attorney how often they will update you, who you will speak with when you call, and how quickly they return calls. Read their reviews — real clients tell you exactly what the communication experience is like.

Chad Parker’s clients consistently highlight responsiveness and direct access as reasons they recommend the firm.

Red Flags to Watch For When Hiring a Car Accident Lawyer

Not every attorney advertising car accident representation in the Tyler area is equally qualified. Watch for these warning signs:

They pressure you to sign immediately

. A reputable attorney wants you to be comfortable before signing a contract. If someone is pushing you to sign on the spot — especially at the accident scene or hospital — walk away.

          They guarantee a specific outcome

. No attorney can ethically guarantee a settlement amount or verdict. Anyone who promises you a specific dollar figure before evaluating your case is telling you what you want to hear, not what is true.

They are hard to reach before you sign — and harder to reach after

. If it takes days to get a return call during the intake process, imagine what communication will be like once they have your case.

          They settle everything fast

. Speed is not always a virtue in personal injury. A case settled before you have finished medical treatment may leave significant future medical costs unaccounted for. A fast settlement can feel like a win until you discover your injuries are more serious than initially thought — and you’ve already signed away your right to recover more.

          They don’t know Smith County

. Local knowledge matters. An attorney who primarily practices in Dallas or Houston and handles East Texas cases on the side does not have the same relationship with local courts, local juries, and local defense firms that a Tyler-based attorney does.

What Makes a Car Accident Case Strong in Smith County?

Understanding what builds a strong case helps you protect yourself from the moment of impact forward.

          Clear Liability

The strongest cases are those where the other driver’s fault is unambiguous — a rear-end collision, a red light violation captured on traffic camera, a DWI arrest at the scene. The more clearly fault is established, the harder it is for the insurance company to argue their driver wasn’t responsible.

Even in cases with disputed liability, an experienced attorney can use accident reconstruction, witness testimony, police reports, and physical evidence to build a compelling picture of what actually happened.

          Documented Injuries With Medical Treatment

The value of your case is directly tied to your medical records. Insurance companies look at what treatment you received, how consistently you followed your doctor’s recommendations, and how your injuries progressed over time. Gaps in treatment — weeks where you didn’t see a doctor — are used to argue your injuries weren’t serious.

See a doctor immediately after your accident. Follow through with every referral. Don’t stop treatment until your doctor releases you.

A Clear Connection Between the Accident and Your Injuries

Insurance companies will look for any explanation other than the accident for your injuries. Prior conditions, prior accidents, delays in seeking treatment — all are used to argue that your injuries pre-existed the crash or were caused by something else. The cleaner and more direct the connection between the accident and your injuries, the stronger the case.

The types of injuries sustained in car accidents directly affect the value of your claim and the complexity of your case. At J. Chad Parker PLLC, we have represented clients with the full spectrum of crash injuries, including:

          Traumatic brain injuries (TBI)

           — Ranging from concussions to severe brain trauma, TBIs are among the most serious and most underdiagnosed injuries in car accidents. Symptoms may not appear immediately, and the long-term impact on cognitive function, personality, and quality of life can be profound.

          Spinal cord injuries

          — Herniated discs, fractured vertebrae, and spinal cord damage can cause chronic pain, limited mobility, and in severe cases, permanent paralysis. These injuries often require surgery and long-term physical therapy.

          Neck and back injuries

          — Whiplash is the most common injury in rear-end collisions. Insurance companies routinely try to minimize whiplash claims, dismissing them as minor. An experienced attorney knows how to document and present these injuries properly.

          Broken bones

          — Fractures of the arms, legs, ribs, wrists, and pelvis are common in moderate to severe crashes. Recovery timelines vary significantly, and complications can arise.

          Internal injuries

           — Damage to internal organs is not always immediately apparent. Abdominal pain, dizziness, and fatigue after an accident should be evaluated immediately.

Frequently Asked Questions: Choosing a Car Accident Lawyer Near Tyler, TX

How soon after a car accident should I contact a lawyer?

Immediately. Evidence is time-sensitive. Surveillance footage gets overwritten. Witnesses’ memories fade. Skid marks disappear. The sooner an attorney gets involved, the better positioned you are to preserve everything that matters to your case.

What if I was partially at fault for the accident?

You can still recover under Texas law as long as you were not more than 50% at fault. Your recovery is reduced by your percentage of fault. Don’t assume you can’t recover just because you share some responsibility — let an attorney evaluate the facts.

What if the other driver fled the scene?

Hit-and-run accidents are unfortunately common. Your own uninsured motorist coverage may apply, and there may be other avenues for recovery depending on the circumstances. Contact us to discuss your specific situation.

Can I switch lawyers if I’m unhappy with my current attorney?

Yes. You have the right to change attorneys at any time. There are logistics involved in transferring a case, but dissatisfaction with your current representation is a valid reason to seek a second opinion. Contact our office and we can walk you through how a transfer would work.

What if my injuries showed up days after the accident?

This is extremely common. Seek medical treatment as soon as symptoms appear, document the connection to the accident clearly with your doctor, and contact an attorney. Delayed-onset injuries are well understood in personal injury law — what matters is that you document them properly.

Choosing the right car accident attorney in Tyler, Texas is one of the most consequential decisions you’ll make after a crash. The wrong choice means a fast settlement that undervalues your injuries. The right choice means an attorney who builds your case completely, negotiates from strength, and takes it to a Smith County jury if the insurance company won’t do right by you.

Most people assume all personal injury lawyers do roughly the same thing. They don’t.

The difference between a high-volume settlement mill and a trial-ready attorney like Chad Parker can mean tens of thousands — or hundreds of thousands — of dollars in your pocket.

Here is why: Insurance companies track attorneys. They maintain internal records on which lawyers take cases to trial and which ones always settle. When an insurance adjuster sees a demand letter from an attorney with a proven trial record and real jury verdicts in Smith County, they price the case differently than when they get a letter from an attorney known for folding before trial.

Chad Parker has been board certified in personal injury trial law by the Texas Board of Legal Specialization since 1998. That certification isn’t handed out. It requires demonstrated courtroom experience, peer evaluation, and ongoing education. Less than 2% of Texas attorneys hold board certification in any specialty.

When you hire Chad Parker, the insurance company knows they are dealing with someone who will take the case all the way — and that changes what they put on the table.

7 Questions to Ask Before Hiring a Car Accident Lawyer in Tyler

          6. Do You Have Experience With Cases Like Mine?

Not all car accident cases are the same. A rear-end collision on Loop 323 is different from a T-bone intersection crash, a drunk driving accident, or an 18-wheeler wreck on I-20. Ask the attorney about their specific experience with your type of accident and injury.

          7. How Is Your Fee Structured?

Car accident lawyers work on contingency — meaning you pay nothing upfront and no out-of-pocket fees during the case. The attorney’s fee comes as a percentage of the recovery at the end. Make sure you understand exactly what that percentage is and what expenses come out of your recovery.

At J. Chad Parker PLLC, if we don’t recover for you, you owe us nothing.

          Economic Losses That Are Well-Documented

Lost wages, medical bills, future treatment costs, and other economic losses need to be supported by documentation. Pay stubs, employer letters, medical billing records, and in serious cases, expert testimony about future medical needs and lost earning capacity all contribute to a quantifiable picture of what the accident actually cost you.

An Attorney Who Builds the Case Fully Before Settling

Chad Parker personally reviews demand packages before they go to the insurance company. He ensures that every element of your damages is captured — not just what’s easy to document, but pain and suffering, mental anguish, and long-term impact on your life. Insurance companies respond to complete, well-supported demands differently than they respond to thin ones.

What to Do Immediately After a Car Accident in Tyler, TX

The actions you take in the hours and days following a car accident directly affect the value of your claim. Insurance companies look for reasons to minimize or deny payouts — and the steps you take (or don’t take) give them either ammunition or a reason to pay.

          1. Call 911

Always call 911 after a car accident in Smith County, even if the crash seems minor. A police report is one of the most important documents in your case. It establishes the facts of the accident, records witness information, and in many cases includes the officer’s assessment of fault. Never agree to handle a collision “privately” without a police report — the other driver’s story will change the moment they talk to their insurance company.

          2. Seek Medical Attention Immediately

Do not wait to see a doctor. Many serious injuries — including traumatic brain injuries, spinal injuries, and internal bleeding — do not produce immediate, obvious symptoms. Adrenaline masks pain. What feels like soreness today can be a herniated disc tomorrow.

More importantly, if you wait days or weeks to seek medical treatment, the insurance company will use that gap to argue that you weren’t really injured in the accident — or that your injuries were caused by something else entirely. Go to the emergency room or an urgent care clinic the same day, even if you feel relatively okay.

This documentation can be critical evidence, especially in cases where the other driver later changes their account of what happened.

          4. Do Not Admit Fault or Apologize

Do not say “I’m sorry” at the scene — even as a reflexive, polite response. Do not speculate about what happened or who was at fault. Stick to the facts when speaking with police. Anything you say at the scene can and will be used against you by the other driver’s insurance company.

          5. Contact a Tyler Car Accident Lawyer Before Talking to Insurance

This is the step most accident victims skip — and it costs them significantly. The other driver’s insurance company will contact you quickly. They will be friendly, sympathetic, and eager to get a recorded statement or offer you a fast settlement.

Why Insurance Companies Are Not on Your Side

This point cannot be overstated. Insurance companies — even your own — are businesses. Their goal is to pay as little as possible on every claim. They have teams of adjusters, investigators, and lawyers whose job is to find reasons to reduce or deny your payout.

Here is how they do it:

          They call you fast

. The adjuster reaches out within days of the accident — before you’ve had time to understand the full extent of your injuries or consult an attorney. They want to lock you into a statement or a settlement before you know what your case is worth.

          They ask leading questions

. A recorded statement is not a friendly conversation. The adjuster is trained to ask questions designed to get you to say things that can be used to minimize your claim. “Were you watching the road?” “Did you have time to brake?” These questions have a purpose.

          They lowball the first offer

. The first settlement offer is almost never close to what your case is actually worth. It’s a starting point designed to see if you’ll take it. Many people do — and they sign away their right to recover anything more, even after discovering weeks later that their injuries are far more serious than initially thought.

          They delay

. If you don’t take the lowball offer, some insurers will drag the process out, hoping that financial pressure will eventually force you to accept less than you deserve.

An experienced car accident attorney in Tyler changes this dynamic entirely. When you have legal representation, the insurance company knows they can’t play games. Every communication goes through your attorney. Your rights are protected from day one.

Texas law allows accident victims to recover compensation for a wide range of damages. Depending on the facts of your case, you may be entitled to:

In cases involving gross negligence — such as drunk driving, street racing, or extreme recklessness — Texas law allows for punitive (exemplary) damages beyond the compensatory damages above. These are designed to punish the at-fault driver and deter similar conduct.

system. This means that even if you were partially at fault for the accident, you can still recover damages — as long as you were not more than 50% responsible.

However, your recovery is reduced by your percentage of fault. If you were found 20% at fault and your damages total $100,000, you would recover $80,000.

Insurance companies know this and will aggressively try to assign fault to you — even when you did nothing wrong — specifically to reduce what they have to pay. Having an attorney who can build a strong case establishing the other driver’s fault is critical to protecting your full recovery.

Smith County sees its share of serious car accidents every year. The most common causes we handle include:

           — Texting, phone use, and other distractions behind the wheel are a leading cause of accidents on Loop 323, US-69, and throughout Tyler.

           — DWI crashes cause some of the most severe injuries and fatalities in East Texas. These cases often support punitive damages in addition to compensatory recovery.

           — Excessive speed reduces reaction time and dramatically increases the severity of impact. Speeding-related crashes are common on US-271, SH-64, and I-20 near the Smith County area.

          — Tailgating and sudden stops cause rear-end crashes that frequently result in whiplash, neck injuries, and back injuries — injuries that insurance companies routinely try to minimize.

           — Tyler sits along major freight corridors. Accidents involving 18-wheelers and commercial trucks are complex cases with higher stakes and multiple potentially liable parties — including the driver, the trucking company, and sometimes the vehicle manufacturer or cargo loader.

Two years sounds like a long time, but the reality is that building a strong car accident case takes time. Evidence needs to be preserved. Witnesses need to be identified and interviewed. Medical records need to be gathered. Accident reconstruction may be needed. The sooner you involve an attorney, the better your case will be.

Do not wait. Evidence disappears. Witnesses move or forget details. Surveillance footage gets overwritten. The strongest car accident cases are built by attorneys who get involved early.

How long will my car accident case take?

It depends on the complexity of your case and whether the insurance company is willing to settle for a fair amount. Straightforward cases with clear liability can resolve in a few months. Cases involving serious injuries, disputed liability, or uncooperative insurers may take longer — and going to trial extends the timeline further. What we won’t do is rush a settlement that undervalues your case just to close the file.

What if the other driver doesn’t have insurance?

Texas law requires drivers to carry minimum liability insurance, but many don’t. If you’re hit by an uninsured driver, your own uninsured motorist (UM) coverage may apply. Even if you don’t have UM coverage, there may be other avenues for recovery. Contact us to discuss your options.

Should I accept the insurance company’s first offer?

Almost never. First offers are almost always significantly below what your case is worth. Before accepting anything, speak with an attorney who can evaluate what your claim is actually worth — including future medical costs, long-term impacts on your ability to work, and pain and suffering.

What if I was partially at fault for the accident?

You may still be able to recover under Texas’s modified comparative fault rules, as long as you were not more than 50% at fault. Your recovery will be reduced by your percentage of fault, which is exactly why having an attorney to fight against inflated fault assignments is so important.

Do I need a lawyer if the accident was minor?

Even “minor” accidents can result in injuries that aren’t immediately apparent. And once you accept a settlement and sign a release, you cannot go back and recover more — even if your injuries turn out to be more serious than initially thought. At minimum, consult with an attorney before signing anything.

One of the very first things that you do is decide on a lawyer. The lawyer that you choose has a contract that you will have to sign for him or her to represent you. The contract controls most aspects of the case. Will they charge you for helping with property damage? Will they charge you for recovering PIP (personal injury protection)? The contract usually indicates that there is a fee for a resolution of the case before a lawsuit is filed. Oftentimes, lawyers charge a greater percentage once your case is in litigation (a lawsuit has been filed). Some lawyers charge an even higher fee if the case goes to trial. With that understanding, you can see how the same settlement offer could be more money for you at one point in the case and significantly less, much later in the case. That is always something to think about during your case.

People want value for the service they receive. I understand that, which is why my office handles the property damage for free. I rarely take a fee off a person’s PIP. People do not quite understand PIP. It is a coverage that they paid for, yes, but it is specifically for medical bills. It is not something to be recovered and given to the client, although I do that in some cases when I believe the ultimate outcome will NET enough money to compensate for the lack of those funds. The lawyer’s effort prior to filing a suit is very important. If little effort is put forward to present your case, then it is most likely the offer will reflect that. It is also at a time when the attorney’s fees would be the lowest. The goal should be to get a genuine look at your NET (money in your pocket) before a suit is filed. That is the ideal time to resolve a case if possible. It is not always possible to resolve a case without filing a lawsuit. I have said that in other blogs. Sometimes the filing of a lawsuit generates an outcome that is better even after paying 40%. It is important to also understand that after filing suit, it may be advantageous to you to continue on to the mediation. At a mediation the other side is often motivated to resolve the claim, if they can, because of ongoing attorney fee expenses and case expenses that will be incurred through a trial. Lawyers with fees that increase after mediation are often in place to force you to accept the offer and not go to trial. I do not have an increase in my fee other than from pre-litigation to the time in which a lawsuit is filed. That gives you consistency in determining the outcome. You can always understand that if you add medical expenses, then those will have to be paid back. The gross settlement will be something that attorney’s fees are taken from FIRST. The medical expenses will be paid back next. Oftentimes healthcare providers will reduce their medical expenses in an effort to ensure payment. They also understand that the case will be or is being resolved, and they will receive payment for their services with certainty.

It should be apparent that a good settlement, with a pre-litigation fee (33.3%), with cooperative healthcare providers, will oftentimes be one of the best opportunities for you to have a good NET (the money in your pocket).

The entirety of a personal injury case can be summed up as eventually concluding with math. What I mean by that is you will have a contract with your lawyer regarding percentages at different times in the case. A big portion of your case will be about your medical bills and expenses. There will also be expenses incurred in moving your case along by your lawyer that you are required to pay back at the end. Finally, there is ultimately a settlement or a jury verdict, which is normally one of the two endings to your case. Most cases settle, and so the settlement number will be a big part of the math in determining how your case ends up with regard to the payment of your lawyer, the file expenses, the healthcare expenses, and ultimately what you will NET (or put in your pocket).

Sometimes there is not enough insurance available in a case. Either the person who caused the accident does not have any or not very much, and you may or may not have underinsured/uninsured motorist coverage. If that is true, then there are times when you have to make decisions about medical treatment, which have a related cost. For instance, if you had $30,000 in medical expenses and you anticipated the other side had $30,000 in insurance, then it would be difficult for a whole lot of medical procedures to continue to take place. Why you ask? The medical providers would have no real chance of ever being paid. If a medical provider is seeing you on an LOP (Letter of Protection), then there is a general understanding and expectation that the lawyers manage the situation so that they have a good chance, at the very least, to be paid for their services. That certainly makes sense as these doctors are oftentimes helping you

The lawyer that you choose to represent you has a huge impact on the car wreck math. If their goal is to build up the medical expenses without any thought about the available limits, then you will likely get very little, if anything, in your pocket when it is over. The whole process should be about setting you up for the best outcome. If you understand what your “choices” are, then you are better prepared for a good outcome. The efficiency of your lawyer in regard to the “timing” of a resolution also plays a role. Remember, fees often change between the pre-litigation phase and the time in which a lawsuit is filed. The best effort should be made in the pre-litigation phase when the fee is the smallest. This creates chances for better outcomes. However, it is true that filing suit oftentimes yields much better outcomes. That is not in all circumstances, especially smaller soft tissue car wrecks. Understanding the approximate medical expenses as the case goes along, along with relevant insurance information puts you in the best position to make good decisions. A perfect solution for your case is the appropriate amount of medical treatment with resolution of symptoms combined with the maximum amount of money recovered.

A lot of my clients tell me that they hired me because they could not get a call back from the insurance company. They felt something was “strange” but didn’t necessarily know what it was. The insurance company seemed to have no sense of urgency to talk to them about fixing their vehicle or whether or not there were any injuries. A lot of times the insurance company is “hoping” to avoid responsibility altogether. If they don’t address it, they are hoping that you will get a rental car through your own insurance, or you won’t ask for a rental. If you are in need of medical treatment or went to the emergency room, they are hoping that you have health insurance, and you never call on the at fault party insurance to pay the damages. You would be surprised how many people simply go away after getting THE RUN AROUND for the first couple of weeks.

It’s a very effective tactic by the insurance companies. What do I mean? If they keep you from seeking any medical treatment for a couple of weeks or don’t fix your car and you can’t go to any medical treatment, then there is a built-in advantage. At a later date, they are going to claim that there is a “gap in treatment”. That basically means the insurance company is thinking that if you were hurt you would have gone to see a doctor sooner. It’s a tactic and a talking point used by adjusters all the time. It has no basis and in fact a lot of times is the direct result of their own inaction. They know if they give you the run around for long enough, your claim will be worth significantly less in the future or it could be.

My advice is always to contact an attorney immediately after an accident, even if it’s not me. You’re going to need help with your car unless it is drivable. If it was damaged, it’s going to have to be repaired, and you want it to be done thoroughly. If your car is totaled, then will want to get a fair value for your car. In the meantime, you may need help with a rental car. I do all of this through my office without charging a fee. With regard to bodily injury, it’s been well documented that most people don’t feel the full effects of their injuries for 24-48 hours following a car accident. They often times don’t have health insurance or know where to go. Hiring a lawyer opens up options and opportunities for you that you would not otherwise have.

          Consequences of No Police Report

There are several reasons why the police may not come to the scene of the accident. (1) you and the person involved may not call the police; (2) it may be in a private parking lot or (3) it may be an accident with little or no damage or injuries at the time. That can cause complications in getting your case resolved. You won’t have the benefit of an authority documenting vehicles, license plate numbers, driver’s license numbers, or who was at fault. You can be your own investigator and that is probably a good idea.

You have a cellphone and the ability to take a photograph of the other person’s license plate. You can take a photograph of the person as well as their driver’s license plate and insurance card in the event that there is a question about who was driving later on. The property damage can also be documented with regard to the location of the damage to the vehicle. A photograph of where the vehicles were at the time of the accident may prove extremely helpful if the other person’s story changes at a later date. That story often changes from the scene of the accident up to the time that a person talks to the insurance adjuster about what happened. You can go from feeling like a good Samaritan by not calling the authorities to being a victim of the insurance company’s desire to limit or deny claims.

The insurance adjuster’s job is to limit claims that they “don’t feel are justified”. That means they are not going to resolve any of the differences in your favor. If the evidence doesn’t exist, they are going to assume the opposite. For instance, if both parties claim that they had a green light then the adjuster is going to support their insured and deny liability. That’s why it’s important to take the name and telephone number of any witness at the scene of the accident. You could also record a witness giving a brief statement about what they saw and who they felt were at fault. You never know when you might need this information at a later time to present to the insurance adjuster so that they cannot try to deny your claim.

The police are very busy, especially in larger cities. They are going to prioritize calls. If you have been involved in a car wreck where there is property damage and you may be slightly hurt, there may not be a response by the authorities. Also, many people are full of adrenaline and not hurt at the scene of the accident and ultimately don’t feel the full effect of their injuries until later. The only thing the insurance companies like about the investigation by the police at the scene is if you claim not to need an ambulance or not be injured at that time. The at fault party’s story usually changes after they leave the scene, and you likely begin to feel injuries at a later date. Be proactive in your situation. Make sure you have the “evidence” to prove your version if the police don’t create their own.
